ORDINANCE NO. 2025-07A

AN ORDINANCE TO AMEND AND REENACT SECTIONS 11-5029,
OPEN GLASS OR METAL CONTAINERS IN PUBLIC PLACES PROHIBITED

BE IT ORDAINED by the Mayor and Board of Aldermen of the City of Jeanerette, in regular session assembled,

That the Code of Ordinance of the City of Jeanerette, SECTION 11-50291 is hereby AMENDED and REENACTED to read as follows, to wit:


BE IT THEREFORE ORDAINED, by the Board of Aldermen, City of Jeanerette, State of Louisiana, that items (a) & (b) be amended, as shown in italic, and item (d) be added and the ordinance now read

(a) It shall be unlawful for any person to carry or drink from any open container upon which the seal has been broken, or any receptacle without lids, or with lids, or only partial lids or straws protruding therefrom and which contains or did contain any nonprescription alcoholic beverage, in, above or on any public street, sidewalk, park, playground or other unenclosed public place in the City of Jeanerette.
(b) The owner of every establishment selling beverages having any alcoholic content in any open container in the city shall be required to post a copy of this section on or near every public exit from such establishment. Failure to post such copies shall be unlawful. Copies may be obtained from the city clerk of the City of Jeanerette.
(d). Definition: Open container means any drinking or pouring vessel, receptacle, including any open or unsealed container, receptacle without lids, or with lids, or with only partial lids, or with straws protruding therefrom.

BE IT FURTHER ORDAINED, that all ordinances and resolutions in conflict herewith are hereby repealed.

This Ordinance shall take effect and be in force 10 days after its adoption.

This Ordinance was introduced on the 21th day of July 2025 by Alderwoman Moore and second by Alderwoman Simmons notice of public hearing having been posted on July 22nd, 2025, said public hearing having been held on August 11, 2025 the title having been read and the ordinance considered, on motion of Alderman Bourgeois whom moved its adoption, seconded by Alderwoman Simmons, and upon roll call was adopted by its title, section by section, and as a whole, by the following yeas and nay vote:
YEAS: Alderwoman Clay, Alderwoman Moore, Alderman Bourgeois, Alderwoman Simmons, Alderman Duplechain
NAYS: None
ABSTAIN: None
ABSENT: None

This Ordinance was thereupon declared adopted by Mayor and was approved and signed by him and attested by the City Clerk and the corporate seal of the City of Jeanerette affixed hereto on this 12th day of August, 2025.
